Right of Withdrawal (EU customers)

Consumers are entitled to the right of withdrawal described below. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 German Civil Code).

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of conclusion of the contract. The contract is concluded upon our confirmation email or upon provision of the booked event gallery.

by means of a clear statement (e.g. a letter sent by mail or an email) of your decision to withdraw from this contract. An informal statement is sufficient; you do not have to give any reasons. You may use the model withdrawal form printed below, but this is not obligatory. You can also declare your withdrawal online using the “Withdraw from contract here” button; it is at the top of this page and in the footer of every page of our website. We will confirm receipt to you by email without delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction (usually the payment method used via Stripe), unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Compensation for Value in Case of Early Commencement

If you requested that the services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

The calculation is based on the value of the services provided up to your withdrawal relative to the total scope of the booked service, not merely on the time elapsed. The core of the service is the event gallery for your event: your guests upload photos and videos during the event, and everyone can view them together. If the event has already taken place, this core has been provided; all that remains is the further provision for viewing and downloading until the end of the term. If you withdraw before the event, only the setup and activation have been provided, and the compensation will be correspondingly low.

Expiry of the Right of Withdrawal (§ 356 (5) German Civil Code)

Our event galleries are a digital service. Your right of withdrawal expires once we have fully performed the service, provided we only began performance after you have

expressly consented to us beginning performance of the contract before the end of the withdrawal period, and
acknowledged that you thereby lose your right of withdrawal upon complete performance of the contract.

We obtain this express consent and acknowledgment during the booking process via a separate mandatory checkbox. The booked event gallery is activated immediately after payment so that it is available to you right away. You will also receive confirmation of the contract on a durable medium (confirmation email, § 312f German Civil Code). Until the service has been fully performed, you can still withdraw from the contract; for the services provided up to that point, compensation applies as set out in the previous section.
